1. About EarlyBirdit

EarlyBirdit is a free community platform for discovering and sharing garage sales, estate sales, and yard sales — primarily serving West Michigan. The app allows users to browse sale listings on a map, check in to sales to earn points, post their own sale listings, and report signs they spot around town.

EarlyBirdit is operated by The EarlyBird App LLC. By creating an account or using the app, you agree to be bound by these Terms of Service and our Privacy Policy.

2. Eligibility

You must be at least 13 years old to use EarlyBirdit. By creating an account, you represent that you meet this age requirement.

If you are under 18, you represent that your parent or guardian has reviewed and agreed to these terms on your behalf.

3. Your Account

You are responsible for maintaining the security of your account credentials. Do not share your password with others. You are responsible for all activity that occurs under your account.

You must provide accurate information when creating your account. Using a false name or impersonating another person is not permitted.

You may only create one account per person. Duplicate accounts may be removed.

4. Listings & Content

When you post a sale listing or report a sign, you are responsible for the accuracy of the information you provide. Posting false, misleading, or fabricated listings is not permitted and may result in account suspension.

By submitting content (listings, photos, descriptions, sign reports), you grant EarlyBirdit a non-exclusive, royalty-free license to display that content within the app for the purpose of operating the service.

Sale listings are automatically removed after the listing's end date. EarlyBirdit reserves the right to remove any listing at any time for any reason, including but not limited to violations of these terms.

Community-reported sign listings are generated from user photos and GPS data. EarlyBirdit does not verify the accuracy of community reports and is not responsible for incorrect or outdated information.

5. Prohibited Conduct

You agree not to:

• Post spam, duplicate listings, or fake sale listings
• Harass, threaten, or abuse other users
• Use the app for any commercial purpose other than promoting your own genuine garage sale
• Attempt to manipulate the points or leaderboard system through artificial means
• Scrape, crawl, or extract data from EarlyBirdit in an automated manner
• Attempt to gain unauthorized access to any part of the service or its infrastructure
• Use the app in any way that violates applicable local, state, or federal law

Violations may result in immediate account suspension or permanent ban without notice.

6. Points, Badges & Levels

EarlyBirdit has a points and achievement system to recognize community participation. Points, badges, and levels are features of the app and have no monetary value. They cannot be exchanged for cash, goods, or services.

EarlyBirdit reserves the right to adjust, reset, or modify the points system at any time. Points may be removed if an account is found to have earned them through prohibited conduct.

7. Disclaimers

EarlyBirdit is provided "as is" without warranty of any kind. We do not guarantee that the app will be available at all times, that listings will be accurate, or that check-ins will always work correctly.

EarlyBirdit is not responsible for the quality, safety, accuracy, or legality of items sold at any garage sale listed on the platform. All transactions between buyers and sellers happen entirely outside of EarlyBirdit. We have no involvement in and bear no responsibility for those transactions.

Sale times, addresses, and details are provided by community members and may be incorrect or outdated. Always verify a sale is happening before making a trip.

8. Refund Policy

EarlyBirdit listing boosts (Featured Listing, Push Notification Blast, and Bundle) are digital services that activate immediately upon payment confirmation.

• Non-refundable once activated — once a boost is live on the map, refunds are not available as the service has been delivered
• Technical errors — if your boost was not activated due to a technical error on our end, contact support@earlybirdit.com within 24 hours for a full refund
• Duplicate charges — accidental duplicate charges will be refunded immediately upon verification
• Seller deletes listing — if you delete your boosted listing before the sale date, no refund is available as the featured placement was active during that time
• Stripe fees — Stripe's processing fee (2.9% + $0.30) is non-recoverable and will be deducted from any eligible refund

9. Account Termination

You may delete your account at any time by contacting us at support@earlybirdit.com.

EarlyBirdit reserves the right to suspend or permanently terminate any account that violates these terms, engages in abusive behavior, or for any other reason at our discretion. We will make reasonable efforts to notify you before taking action, but are not obligated to do so in cases of severe violations.

10. Changes to These Terms

We may update these Terms of Service at any time. When we do, we will update the "Last updated" date at the top of this page. Significant changes may be announced within the app.

Continued use of EarlyBirdit after changes are posted constitutes your acceptance of the updated terms. If you do not agree to the updated terms, please stop using the app and contact us to delete your account.

11. Governing Law

These terms are governed by the laws of the State of Michigan, without regard to its conflict of law principles. Any disputes arising from these terms or your use of EarlyBirdit shall be resolved in the courts of Kent County, Michigan.
